Notice is hereby given that the governing body of the City of Kyle, Texas will meet at 7:00 PM on April 18, 2017, at Kyle City Hall, 100 W. Center St., Kyle, Texas 78640, for the purpose of discussing the following agenda.

III.Citizen Comment Period with City Council

The City Council welcomes comments from Citizens early in the agenda of regular meetings. Those wishing to speak are encouraged to sign in before the meeting begins. Speakers may be provided with an opportunity to speak during this time period on any agenda item or any other matter concerning city business, and they must observe the three-minute time limit.

2.(First Reading)  Approve an Ordinance amending the City's Approved Budget for Fiscal Year 2016-17 (Budget Amendment No. 4) by increasing total appropriations for expenditures in the General Fund by $100,000.00 and decreasing the fund balance in the General Fund by the same amount in order to provide funding to reimburse Union Pacific Railroad Company for engineering review costs associated with the City's design for the four rail crossing quiet zones to be constructed in Kyle.  Perwez A. 3.Approve an Agreement for Professional Services with Grant Development Services for grant application and administration. ~ Jason Biemer, Division Manager, Treatment Operations

Approve Ariza at Plum Creek - Site Plan (SD-17-002) 13.736 acres; 1 multi-family lot located on the corner of Dorman and Cromwell Drive. ~ Howard J. Koontz, Director of Planning and Community Development

 

Planning and Zoning Commission voted 7-0 to approve the site plan.

 
5.Approve Change Order No. 1 to TRI-STATE COATINGS, Wadena, MN, in an amount of $43,400.00 for a total contract amount not to exceed $222,900.00 for additional work on the Yarrington and FM 1626 Tanks Rehabilitation  Project. ~ Leon Barba, P.E., City Engineer 
 
6.Approve a contract with ATX GLOBAL TRADING, LLC, Austin, Texas for the proper disposal and sanitation of City of Kyle surplus computer hardware and electronic equipment. ~ Jerry Hendrix, Chief of Staff
 
7.Approve a Resolution of the City of Kyle, Texas Suspending the Proposed Gas Reliability Infrastructure Program Interim Rate Adjustment of Centerpoint Energy Texas Gas. ~ Jerry Hendrix, Chief of Staff

(First Reading) Amending Ordinance 891; Chapter 50 (“Utilities”), Article IX (“Stormwater Regulations”) adopted on February 16, 2016 so as to reflect changes shown in Exhibit A; providing for an effective date; and making such other findings and provisions related hereto. ~ Kathy Roecker, Stormwater Management Plan Administrator

 
9.Declare a Whelen emergency light bar, a siren, and associated equipment as surplus City property and authorize the City Manager to donate such surplus property to the Hays County Emergency Services District #5, Kyle Fire Department for their official use. ~ Jeff Barnett, Chief of Police
 
10.Authorize the Mayor or City Manager to execute a letter of consent to future assignment of an agreement by the City of Kyle for the Amended and Restated Reclaimed Water Use Agreement dated January 18, 2012 between the City of Kyle and Plum Creek Development Partners, LTD. ~ James R. V.Consider and Possible Action
11.

Consider amendments to multiple sections of Chapter 29, Sign Standards and Permits of the City of Kyle, Code of Ordinances. ~ Howard J. Koontz, Director of Planning and Community Development

 

Planning and Zoning voted to postpone the item until the April 25th P&Z meeting.

(First Reading) An Ordinance amending Chapter 53 (Zoning) of the City of Kyle, Texas, for the purpose of rezoning approximately 57.26 acres of land from Retail Service District 'RS' and Single Family Residential-2 'R-1-2' to Planned Unit Development for property located off of W. FM 150 and Old Stagecoach Road, in Hays County, Texas. (Kyle Mortgage Investors, LLC - Z-17-007). ~ Howard J. Koontz, Director of Planning and Community Development

 

Planning and Zoning Commission postponed this item until the May 9th P&Z meeting.

13.

(First Reading)  An Ordinance amending Chapter 53 (Zoning) of the City of Kyle, Texas for the purpose of rezoning approximately 3.93 acres of land from Warehouse District 'W' to Retail Service District 'RS' for property located at 400 Windy Hill Road, in Hays County, Texas. (Ansar and Ali Chmeis - Z-17-006). ~ Howard J. Koontz, Director of Planning and Community Development

 

Planning and Zoning Commission voted 6-1 to recommend approval of Retail Service District.

14.(First Reading) An Ordinance amending Chapter 47, Article II of the Code of Ordinances, Traffic and Vehicles, of the City of Kyle so as to add Sections 47-76 to 47-87 to regulate the parking of vehicles near Lehman High School, specifically Brutus Drive, Onion Cove and Casper Cove during certain days and hours, and to establish regulations governing which vehicles are prohibited from parking and, establishing a penalty and setting an effective date. ~ Jeff Barnett, Chief of Police
 
15.Consider and possible action to approve a Tri-Party agreement Providing for Regulation of subdivision and Approval of Pecan Woods. ~ J. Scott Sellers, City Manager

VII.Executive Session
17.

Pursuant to Chapter 551, Texas Government Code, the City Council reserves the right to convene into Executive Session(s) from time to time as deemed necessary during this meeting.  The City Council may convene into Executive Session pursuant to any lawful exception contained in Chapter 551 of the Texas Government Code including any or all of the following topics.

  1. Pending or contemplated litigation or to seek the advice of the City Attorney pursuant to Section 551.071.
    • Code violations at property located on Center Street
  2. Possible purchase, exchange, lease, or value of real estate pursuant to Section 551.072.
    • Easement Acquisition
  3. Personnel matters pursuant to Section 551.074.
  4. Economic Development negotiations pursuant to Section 551.087.
 
18.Take action on items discussed in Executive Session.
 
VIII.ADJOURN
 At any time during the Regular City Council Meeting, the City Council may adjourn into an Executive Session, as needed, on any item listed on the agenda for which state law authorizes Executive Session to be held  

 *Per Texas Attorney General Opinion No. JC-0169; Open Meeting & Agenda Requirements, Dated January 24, 2000: The permissible responses to a general member communication at the meeting are limited by 551.042, as follows: "SEC. 551.042. Inquiry Made at Meeting.
