Notice is hereby given that the governing body of the City of Kyle, Texas will meet at 7:00 PM on August 1, 2017, at Kyle City Hall, 100 W. Center St., Kyle, Texas 78640, for the purpose of discussing the following agenda.

II.Citizen Comment Period with City Council

The City Council welcomes comments from Citizens early in the agenda of regular meetings. Those wishing to speak are encouraged to sign in before the meeting begins. Speakers may be provided with an opportunity to speak during this time period on any agenda item or any other matter concerning city business, and they must observe the three-minute time limit.

III.Consider and Possible Action
1.

(Second Reading) An Ordinance amending Chapter 53 (Zoning) of the City of Kyle, Texas for the purpose of rezoning approximately 38.78 acres of land from Entertainment District 'E' to Warehouse District 'W' for property located at 24801 N. IH-35, in Hays County, Texas. (FM 158 Land, Ltd. - Z-17-012) ~ J. Scott Sellers, City Manager

 

Planning and Zoning Commission voted 3-2 to recommend approval of the request.

 

 
2.(First Reading) An Ordinance of the City of Kyle, Texas, in accordance with Chapter 47, Article III authorizing and directing the installation and erection of NO PARKING signs to prohibit parking on Lox from East RR 150 to Stennis in the city limits of Kyle; fixing a penalty therefor; providing for severability; providing for repeal of conflicting ordinances; and ordaining other provisions related to the subject matter thereof. ~ J. 3.Authorize award and execution of a Purchase Order to ANDERSON MACHINERY COMPANY, San Antonio, Texas in an amount not to exceed $113,547.06 for the purchase of one (1) new GEHL RT-250 Skid Steer and assorted attachments through the Buy Board Purchasing Cooperative for the Storm Drainage & Flood Mitigation Utility in Public Works Department. ~ J. 4.Authorize award and execution of a Purchase Order to CALDWELL COUNTRY CHEVROLET, Caldwell, Texas in an amount not to exceed $39,894.00 for the purchase of one (1) new 2018 Chevrolet 3500HD Silverado 4X4 crew cab truck through the Buy Board Purchasing Cooperative for the Storm Drainage & Flood Risk Mitigation Utility in Public Works Department. ~ J. 5.

(First Reading) An Ordinance amending the Code of Ordinances of the City of Kyle, Texas; amending Chapter 53 ("Zoning"), Article 1; Article IV; Division 1; authorizing the City Secretary to amend ordinance 438 of the City of Kyle so as to reflect this change; adding definitions; providing standards to encourage diversity of neighborhood and housing design in Kyle; creating a conditional use process for the review and approval of new one- and two-family housing subdivisions; providing standards for determining appropriateness of neighborhood design; providing standards for determining appropriateness of residential architecture and architectural features. ~ J. 6.(Second Reading) An Ordinance of the City Council of the City of Kyle, Texas to repeal Chapter 38, Division 2, Paragraphs 38-41 thru 38-44, and to amend the City's Official Code of Ordinances Chapter 47 in its entirety, to prescribe the lawful time, manner, and place for parking, stopping, and/or standing of automobiles and trailers upon both public rights of way and private property, providing a penalty for violations, providing for severability, and providing an effective date. ~ James R. 7.Consideration and possible action as may be appropriate in regards to authorizing the Mayor to execute a Development Agreement for 171 acres bounded by Opal and Roland Lane, currently owned by the Driskell family, with Intermandeco, the proposed developer of the property. ~ James R. 8.Consider and possible action on amendment to existing approval of the downtown revitalization grant awarded to 110 W. Center St. in the amount of $19,000. ~ Diana Torres, Director of Economic Development
 
9.

Consider a request by LGI Homes-Texas, LLC for multiple waivers from the City Code of Ordinances for Bunton Creek Subdivision, Phase 3 located off of Treeta Trail and Running Creek Drive. (W-17-001) ~ Howard J. Koontz, Director of Planning and Community Development

 

  • Chapter 41, Article 5, Section 41-137(k)(1) which requires 60-foot ROW width for residential lanes. (Treeta Trail)

  • Chapter 41, Article 5, Section 41-137 (k)(1) which requires 38-foot pavement width for collector streets. (Winding Creek)

 

  • Chapter 41, Article 5, Section 41-137 (h)(1) limits the length of dead-end roads with cul-de-sacs to 200-feet for residential zoning. (Breanna Lane)

  • Chapter 53, Article 2, Division 1, Section 53-33 (k)(9) requires a minimum front width of 65-feet and minimum square footage of 6,825 square feet per residential lot.

11.(First Reading) An Ordinance of the City of Kyle, Texas, ordering a General and Special Election to be held jointly with Hays County on November 7, 2017 for the election of City Council Place One to serve an unexpired term, Place Two, Place Four, and Mayor to serve a three year term; designating the main early voting place for such election; providing for an order and notice of such general and special election; providing for related matters; providing a severability clause; and providing an effective date. ~ R. 12.Consider and take possible action to approve an estimated amount of $6,399.75 for election services in accordance with the approved contract with the Hays County Elections Administrator relating to the November 7, 2017 general and special elections. ~ Jennifer Vetrano, City Secretary

V.Executive Session
14.

Pursuant to Chapter 551, Texas Government Code, the City Council reserves the right to convene into Executive Session(s) from time to time as deemed necessary during this meeting.  The City Council may convene into Executive Session pursuant to any lawful exception contained in Chapter 551 of the Texas Government Code including any or all of the following topics.

  1. Pending or contemplated litigation or to seek the advice of the City Attorney pursuant to Section 551.071.   
  2. Possible purchase, exchange, lease, or value of real estate pursuant to Section 551.072.
  3. Personnel matters pursuant to Section 551.074.
  4. Economic Development negotiations pursuant to Section 551.087.
 
15.Take action on items discussed in Executive Session.
 
VI.ADJOURN
 At any time during the Regular City Council Meeting, the City Council may adjourn into an Executive Session, as needed, on any item listed on the agenda for which state law authorizes Executive Session to be held
