Stormwater Regulations Amendment

(Second Reading) An Ordinance amending Ordinance 891; Chapter 50 (“Utilities”), Article IX (“Stormwater Regulations”) adopted on February 16, 2016 so as to reflect changes shown in Exhibit A; providing for an effective date; and making such other findings and provisions related hereto. ~ Kathy Roecker, Stormwater Management Plan Administrator

These proposed changes are to the City's Stormwater Regulations, not the Storm Drainage and Flood Risk Mitigation Utility Ordinance.

Proposed Changes to Ordinance 891

1. Changed and combined Sections 50-418 and 50-419 so penalties can be pursued through the city’s Municipal Court. Combining the Penalty sections resulted in the renumbering of subsequent sections.
2. Added Stop Work Order as an enforcement measure.
3. Changed the word “minimize” to “prevent” under Sec. 50-410 in multiple places.
4. Added verbiage under Sec. 50-409 to ensure contractors remove temporary BMPs (i.e. silt fencing) once a construction project is completed.
5. Removed specified timeframes under Sec. 50-417 Enforcement.
6. Added Best Management Practices (BMPs) to the title of Sec. 50-410.
7. Added verbal Notice of Violations (NOVs).
8. Changed the verbiage of SECTION 4. Effective Date.
9. Various minor edits.
