Appointment of ETJ Representative to Impact Fee Advisory Committee

Subject/Recommendation:

Consider appointment of Freddie E. Dippel, Jr., P.E., as the City of Kyle's Extra Territorial Jurisdiction (ETJ) Representative on the Impact Fee Advisory Committee as required under Chapter 395 of the Texas Local Government Code for the Water and Wastewater Impact Fee Study. ~ Perwez A. Other Information:

Under Chapter 395 of the Texas Local Government Code, a political subdivision such as the City of Kyle which has adopted a water and wastewater impact fee is required to update such impact fee at least every five (5) years including the land use assumptions and capital improvements plan developed for the calculation of the impact fee.

 

In addition, under Chapter 395 of the Texas Local Government Code, the City of Kyle is required to appoint an Impact Fee Advisory Committee.  The code allows for the Planning & Zoning Commission of a political subdivision to act as the Impact Fee Advisory Committee provided it includes at least one representative of the real estate, development , or building industry; and if the impact fee is to be applied in the extra territorial jurisdiction of the political subdivision, the advisory committee must include a representative from that area.  

 

The Impact Fee Advisory Committee serves in an advisory capacity and is established to:

 

  1. Advise and assist the political subdivision in adopting the water and wastewater land use assumptions;
  2. Review the capital improvements plan and file written comments;
  3. Monitor and evaluate implementation of the capital improvements plan;
  4. File semiannual reports with respect to the progress of the capital improvements plan and report to the political subdivision any perceived inequities in implementing the plan or imposing the impact fee;
  5. Advise the political subdivision of the need to update or revise the land use assumptions, capital improvements plan, and impact fee.

 

Appointments Made by City Council

On September 20, 2016, the City Council appointed members of the Planning & Zoning Commission to act as the Impact Fee Advisory Committee for the City's Water and Wastewater Impact Fee Study.

 

City Council Action Requested

Since the City's Planning & Zoning Commission does not include a representative from the City of Kyle's extra territorial jurisdiction (ETJ), staff is requesting City Council's consideration to appoint the following applicant who resides in the City's ETJ to the Water and Wastewater Impact Fee Advisory Committee:

 

  • Mr. Freddie E. Dippel, Jr., P.E.    

 

Applicant's Background

Mr. Dippel submitted an application expressing his interest to serve on the City's Water and Wastewater Impact Fee Advisory Committee.  Mr. Dippel who has resided in the City of Kyle's ETJ for 18 years is a registered professional engineer in Texas with 40 years of engineering experience in water and wastewater, streets and drainage design and construction.
