Under Chapter 395 of the Texas Local Government Code, a political subdivision such as the City of Kyle which has adopted a water and wastewater impact fee, is required to update such impact fee at least every five (5) years including the land use assumptions and the capital improvements plan used in the calculation of the water and wastewater impact fee.
On June 7, 2016, the City Council approved a professional services agreement with HDR Engineering, Inc., to conduct the Water and Wastewater Impact Fee Study and update all required schedules and reports in compliance with Chapter 395 of the Texas Local Government Code.
In public meetings held on October 25, 2016 and November 7, 2016, the City Council appointed Water and Wastewater Impact Fee Advisory Committee reviewed the updated water and wastewater land use assumptions, the 10-year water and wastewater capital improvements plan used in the calculation of the water and wastewater impact fee, and the 2016 Water and Wastewater Impact Fee Report.
On November 7, 2016, the City's Water and Wastewater Impact Fee Advisory Committee unanimously passed a motion to:
- Approve the land use assumptions and the capital improvements plan used in the calculation of the updated water and wastewater impact fee, and
- Recommend to the City Council to adopt the 2016 Water and Wastewater Impact Fee Report including the combined $6,361 maximum water and wastewater impact fee per LUE (living unit equivalent).
The breakdown of the updated impact fee is provided below:
- Water Impact Fee: $3,535 per LUE
- Wastewater Impact Fee: $2,826 per LUE
- Combined Total: $6,361 per LUE
On November 15, 2016, the City Council approved a Resolution establishing the date for a public hearing to be held on January 3, 2017, as required under Chapter 395 of the Texas Local Government Code, to consider, discuss, and review the update to the water and wastewater land use assumptions, water and wastewater capital improvements plan, and imposition of the updated water and wastewater impact fees.
On November 30, 2016, a notice of public hearing was published in the Hays Free Press. A copy of the public notice is attached.
